Control of Pollution Act 1974 (Part III Noise)

This act covers the noise pollution generated by:

Construction sites: “the erection, construction, alteration, repair or maintenance of buildings, structures of roads; breaking up, opening or boring under any road or adjacent land; demolition or dredging.”
 
Noise in streets: use of loudspeakers

It also states how the local authority may:

• designate all or part of its area a noise abatement zone and specify the classes of premises to which the noise abatement order must apply
• what notices it must give in order to do this
• how it must continue to monitor noise within that designated area
• and what steps it can take if any noise monitored exceeds the registered levels within a premises

The Control of Noise at Work Regulations 2005

This act covers the “assessment of the risk to health and safety created by exposure to noise in the workplace”.

It includes daily and weekly limits and peaks and states what employers must do to control exposure to noise in the workplace e.g. providing hearing protection and designating hearing protection zones and providing instruction and training.

The act also states which areas of employment are exempt and how to gain an exemption certificate.

Nearly all occupations are covered by this legislation.

restaurants.
As well as factories, offices and building site operatives.

The common survey terms are as follows:
BS4142 – This relates to industrial noise that is affecting local residents, it can cover nightclubs to office air conditioning units. We would normally measure the noise emanating from your premises and calculate or measure what is being experienced by the resident(s) concerned. Roughly speaking if the noise you create is more than 5dB above the ambient background noise level then you will need to rectify the problem.

Noise at work Survey - This is a survey that assess employees exposure to noise levels whilst at work, it is based on an averaged 8 hour measurement, so even fairly low noise levels, if sustained for a long period may actually still be more of a problem than higher noise levels for short periods.

PPG24 - This is a planning survey that will need to be carried out on any new residential development of dwellings or flats. We are basically assessing whether background noise is over a pre-defined level inside the proposed dwellings.
